Terms of Service

1. Agreement
These Terms govern your use of Tailwind GPS at tailwindgps.com ("we", "us"). By creating an account or using the service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use Tailwind.
2. The service
Tailwind GPS helps cyclists analyse cycling routes against wind forecasts. Features depend on your plan (Free or Subscriber). We may change, improve, or discontinue features; we will try to give reasonable notice of material changes.
Features marked "coming soon" are not part of the current service.
3. Accounts
You must provide accurate information and keep your account secure. You are responsible for activity under your account. You must be at least 18 years old (or the age of majority in your country) to subscribe.

Prices are shown in USD. Taxes may apply depending on your location and are calculated by Stripe where applicable.
5. Free trial and subscription
- New subscribers receive a 7-day free trial. You will not be charged until the trial ends.
- After the trial, your subscription automatically renews monthly at $2.99 USD unless you cancel before the trial ends or before the next billing date.
- Payment is processed by Stripe. By subscribing, you authorise recurring charges to your payment method.
- Manage or cancel via Settings → Billing → Manage subscription (Stripe Customer Portal).
6. Cancellation and refunds
- You may cancel at any time. Cancellation stops future charges; you retain Subscriber access until the end of the current billing period (or trial, if cancelled during trial).
- Refunds: Except where required by law, subscription fees are non-refundable once a billing period has started. If you cancel during a free trial, you will not be charged.
- If payment fails, we may suspend Subscriber features after a grace period while Stripe retries payment.
7. Consumer rights (UK)
If you are a UK consumer, you have statutory rights including under the Consumer Rights Act 2015. For digital services, you acknowledge that once digital content is supplied during a trial or subscription, your right to cancel under the Consumer Contracts Regulations may be limited where you expressly requested immediate performance. Nothing in these Terms affects your statutory rights.
8. Acceptable use
You agree not to:
- Use Tailwind for unlawful purposes or violate others' rights
- Abuse APIs, scrape the service, or circumvent plan limits
- Upload malicious files or content you do not have rights to use
- Misuse Strava or third-party integrations contrary to their terms
We may suspend or terminate accounts that violate these Terms.
9. Third-party services
Strava: Connecting Strava is optional and subject to Strava's terms. You grant us permission to access Strava data you authorise for import and scoring.
Stripe: Payments are subject to Stripe's terms.
Weather, map, and geocoding data come from third parties; we do not guarantee their accuracy.
10. Intellectual property
We own Tailwind's software, branding, and scoring methods. You retain rights to your route data. You grant us a licence to store, process, and display your routes and related data solely to provide the service.
11. Disclaimers
Tailwind provides weather and wind estimates for planning purposes only. Do not rely on Tailwind for safety-critical decisions. Cycling involves inherent risk; you are responsible for your own safety and compliance with traffic laws.
The service is provided "as is" to the fullest extent permitted by law.
12. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill. Our total liability for any claim arising from these Terms or the service is limited to the greater of (a) amounts you paid us in the 12 months before the claim or (b) £100.
This does not limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
13. Termination
You may stop using Tailwind at any time. We may terminate or suspend access for breach of Terms or if we discontinue the service. On termination, your right to use the service ends; sections that should survive (liability, governing law) continue.
14. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that UK consumers may bring claims in their local courts where permitted.
